PlayNxt Terms of Service

Welcome to PlayNxt! These Terms of Service govern your use of the PlayNxt mobile application, operated by Watchlight Interactive. By using PlayNxt, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using PlayNxt, you agree to be bound by these Terms. If you don't agree, please don't use the App. You must be at least 13 years old to use PlayNxt. If you're under 18, you confirm that your parent or guardian has reviewed and agreed to these Terms.

2. Description of Service

PlayNxt is a game recommendation service that helps you decide what to play based on how much time you have, your current mood or energy level, and your platform and play style preferences. PlayNxt provides recommendations only. We do not sell, distribute, or provide access to the games themselves.

3. User Accounts

3.1 Anonymous Use

You can use PlayNxt without creating an account. Anonymous users have access to all core features.

3.2 Signed-In Accounts

If you sign in with Google or Apple, you are responsible for maintaining account security, providing accurate information, and not sharing your account with others. Notify us of any unauthorized access.

4. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Reverse engineer, decompile, or hack the App
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's servers or networks
• Circumvent any rate limits or access controls
• Impersonate another person or entity
• Use the App to harass, abuse, or harm others

5. Intellectual Property

PlayNxt, including its design, code, and branding, is owned by Watchlight Interactive and protected by intellectual property laws. Game titles, logos, and descriptions are the property of their respective owners, displayed for recommendation purposes under fair use. We are not affiliated with or endorsed by any game publisher unless explicitly stated.

6. Disclaimers

PlayNxt is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. Our recommendations are algorithm-based. We do not guarantee you will enjoy any recommended game, that game information is always current, or that subscription service availability (e.g., Xbox Game Pass, PlayStation Plus) is accurate, as it may vary by region and change at any time.

7. Limitation of Liability

To the maximum extent permitted by law, PlayNxt and its creators shall not be liable for any indirect, incidental, special, or consequential damages, loss of profits, data, or goodwill, or damages exceeding the amount you paid us in the past 12 months.

8. Free and Premium Tiers

8.1 Free Tier (Ad-Supported)

The free version is supported by non-personalized advertisements provided by Google AdMob. By using the free tier, you agree to view ads as part of the service.

8.2 Premium (One-Time Purchase)

PlayNxt Premium is a one-time purchase that permanently removes all advertisements. The purchase is final and non-refundable except as required by law or app store policies. Premium is tied to your app store account and can be restored on other devices. Premium features may be updated over time at no additional cost.

9. Termination

You can stop using PlayNxt at any time. To delete your account and data, go to Settings > Privacy & Data > Delete All Data. We may suspend or terminate your access if you violate these Terms or engage in fraudulent activity.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the United States and the State of Wisconsin. Any disputes shall be resolved in the courts of the State of Wisconsin.

12. Dispute Resolution

Before filing any legal claim, you agree to try to resolve disputes informally by contacting us. If we cannot resolve the dispute within 30 days, either party may proceed with formal legal action.

13. Severability

If any part of these Terms is found unenforceable, the remaining parts will continue to apply.
